Settlements Explained
Personal injury lawsuits and the settlement procedures can be a bit perplexing. Every day, we come across news snippets depicting settlement issues amounting to millions (sometimes even billions) of dollars.
Probably, you might be a bit curious to learn about these paradigms. Certain intricacies surrounding them, along with ample explanations of the settlement processes will be highlighted on this site.
The Process of a Car Accident Claim
After a car accident things can get pretty chaotic so you have to be careful to ensure that you are able to make a proper accident claim. There are a
lot of things that you can do wrong that will cost you money if you have been injured in an accident so you do have to make sure that you know what the claims process is and that you follow it properly.
The first thing that you have to do if you have a car accident is to make sure that if you have suffered any injuries is to go to the hospital.
You do this for two reasons, the first is obviously that you want to make sure that you get any injuries treated. The second reason is so that the
injuries are documented for your car accident claim. This will ensure that there is a record of the injuries when it comes time to work out how much you should receive in a claim.
The next step that you want to make when you are filing a car accident claim is to call both
the police and the insurance company to let them know about the accident. The police will investigate the accident and will file a report.
The insurance company will also do an investigation in order to work out how much they should offer you for compensation. You need to be careful here,
especially when dealing with the insurance company. It is best to say nothing but you absolutely don't want to say anything that can be construed as admitting
liability for the accident or on the extent of any injuries that you have suffered.
If there are any injuries when you have an accident, even minor ones you need to contact a lawyer. This is a call that you should make as soon as you call
the police and the insurance company, you will want to have your lawyer there to help you in dealing with them. In most cases at this point your lawyer will enter
into negotiations with the insurance company to come up with a fair settlement.
However sometimes an agreement can't be reached and your claim will require that you go to court.
If your accident claim requires that you go to court it will take quite a while for you to get your settlement, this is something that you have to be aware of.
This is actually a serious issue if you have suffered injuries that require expensive medical care. This is why your lawyer will usually try to negotiate a settlement
that doesn't require going to court. However if this can't be done you are going to have to be prepared for this. There are companies that can lend you money against
your expected claim so you may want to look into these if going to court is necessary and you can't wait for the money.
